These Terms & Conditions (“Terms”) govern your access to and use of the SmartMoni mobile

application and services (“Services”). The Services are operated by Makanisi Group Pty Ltd, under business name SmartMoni (ABN: 35 687 265 532) (“SmartMoni”, “we”, “our”, “us”).

By using the Services, you agree to these Terms and our Privacy Policy.

1. Eligibility

• You must be located in Australia and able to form a legally binding contract.

• Parents/guardians may manage accounts for minors and are responsible for their use.

2. Your Account & Security

• You are responsible for keeping your login details confidential.

• Notify us immediately if you suspect unauthorized account access.

• We may suspend accounts for fraud or security risks.

3. Financial Services & Transactions

• Payments and transfers are processed via trusted partners including Stripe.

• You authorize us to verify and process financial information.

• Incorrect payment details are your responsibility.

• We may suspend or delay payments for fraud or compliance checks.

4. Fees

• Certain services may incur fees, disclosed before use.

• Fee changes will be communicated ahead of time.

5. Prohibited Conduct

You must not:

• Engage in fraud or illegal activities

• Interfere with security or other users’ accounts

• Commercially exploit or resell the Services

6. Intellectual Property

• Content in the Services is owned or licensed by MonEsmart.

• You may use it for personal, nonncommercial use only.

7. Availability

• Service disruptions may occur due to maintenance or thirdnparty issues.

• We do not guarantee uninterrupted access.

8. Liability

• To the extent permitted by law, we exclude liability for financial loss, lost data, or damages.

• Liability is limited to rensupplying the service or a refund if applicable.

• Your Consumer Law rights remain unaffected.

9. Closing Your Account

• You may close your account via the app or by contacting us.

• We may retain data as required for compliance.

10. Termination by Us

• We may suspend or terminate access for breaches, inaccurate information, or harmful behavior.

11. Changes to Terms

• Updates will be notified via app or email.

• Continued use = acceptance of updated Terms.

12. ThirdnParty Services

• External links or services are not under our control.

• Use of thirdnparty services is at your own risk.

13. Governing Law

• These Terms are governed by the laws of Queensland and Australia.

• Disputes will be handled in Queensland courts.
